General Terms and Conditions of Sale

Preamble

These general terms and conditions of sale apply to any order placed by a consumer, within the meaning of European Directive No. 2011/83/EU of October 25, 2011, regarding products offered for sale on the website WWW.PERLEYI.FR by:

Article 1 - Purpose

PERLEYI offers on the above-mentioned website the sale of jewelry (hereinafter identified as "Products") to Internet users browsing the Site (hereinafter referred to as "CLIENT"). The CLIENT means any adult individual of legal capacity, acting as a consumer or non-professional. Any order for a Product placed on the PERLEYI website is subject to these general terms and conditions of sale.

Article 2 - Products and Services

Only Products listed on the Site on the day of the order and identified as available may be sold to the CLIENT. Product offers and prices are valid as long as the Product is available on the Site. Photographs and graphics illustrating Products on the Site are provided for illustrative purposes only. Each ordered Product is accompanied, upon delivery, by a certificate of authenticity.

Article 3 - Scope and Acceptance of General Terms and Conditions of Sale

3.1 These general terms and conditions of sale define the rights and obligations of the parties in the context of the sale of products offered by PERLEYI to the CLIENT.

3.2 Products may be sold to the CLIENT in two ways: either the sale is concluded directly between the CLIENT and PERLEYI, or the sale is concluded directly between the CLIENT and a Partner, with PERLEYI acting as an intermediary.

3.3 Any order placed on the PERLEYI website implies full acceptance of these terms.

3.4 PERLEYI reserves the right to modify these terms at any time.

Article 4 - Prices

Prices are indicated in Euros including all taxes. The Value Added Tax (VAT) is that in force in French territory on the day of the order. Prices applied are those shown on the Site at the time of the order. PERLEYI cannot be bound by the display of an erroneous and manifestly derisory price. PERLEYI may reserve the right to offer promotional codes, which can only be generated by PERLEYI.

Article 5 - CLIENT Obligations

These general terms and conditions of sale are deemed accepted by the CLIENT at the time of double-click validation of the order. Non-compliance by the CLIENT, particularly in cases of fraud or payment incidents, may result in the deletion of their PERLEYI account. PERLEYI reserves the right to cancel any order for legitimate reasons, including abnormally high quantities, fraud attempts, or payment incidents.

Article 6 - Order

6.1 The CLIENT may place an order from the catalog of Products available on the Site by clicking "Add to Cart."

6.2 The CLIENT reviews the Products on the cart summary page and acknowledges the obligation of payment.

6.3 The order can only be validated if the CLIENT holds a personal account.

6.4 On the cart page, the CLIENT will access delivery options and associated costs.

6.5 The CLIENT may pay by bank card (Carte Bleue, Visa, Eurocard, Mastercard, PayPal, American Express) or PERLEYI gift cards. Payment is processed via SHOPIFY PAYMENTS, certified PCI-DSS by Visa and Mastercard.

6.6 Following payment, an order summary document is sent to the CLIENT by email.

6.7 The CLIENT may track their current order by logging into their personal account under "My Orders."

6.8 The CLIENT may cancel their order free of charge within 30 minutes of placing it.

Article 7 - Delivery and Collection of Products

7.1 The CLIENT may choose home delivery or collection at a partner relay point.

Standard delivery: 3 to 5 business days from the day following payment, with a maximum of 30 days.

Express delivery: Maximum 24/48 business hours from the day following payment.

Relay Point: The CLIENT has 15 business days (Colissimo) or 7 business days (Chrono 2Shop) to collect their order upon notification of delivery. After this period, PERLEYI will cancel and refund the order.

7.2 The risks of loss and damage to ordered Products are transferred to the CLIENT at the time of delivery.

Article 8 - Delayed or Missing Delivery

In case of absent or delayed delivery, the CLIENT may contact PERLEYI Customer Service. PERLEYI will open an investigation with the carrier, generally taking a minimum of twenty-one days. If the parcel is declared lost, PERLEYI will notify the CLIENT and process a refund. All anomaly complaints must be sent to serviceclient@perleyi.fr within three (3) business days of taking possession of the product.

Article 9 - Receipt and Reservation of Order

Upon receipt of the order, the CLIENT must verify the general condition of the parcel. Any anomaly must be reported within 30 days of receipt. Any claim submitted more than 30 days after receipt of the Products will be rejected.

Article 10 - Withdrawal, Exchange, and Refund

In accordance with Article L.221-18 of the French Consumer Code, the CLIENT has 14 calendar days from receipt of the Products to exercise their right of withdrawal, without having to justify reasons or pay penalties. The CLIENT must then return the Products within a maximum of 14 calendar days.

The right of withdrawal cannot be exercised when the Product has been made, modified, adjusted, or clearly personalized at the CLIENT's request.

PERLEYI will refund the CLIENT using the same payment method used for the initial transaction. Return shipping costs are at the CLIENT's expense, except in cases of error attributable to PERLEYI, in which case reimbursable return costs are limited to €10.95.

Article 11 - Return Costs and Procedures

Return costs are at the CLIENT's expense. The CLIENT must return their product within fourteen (14) days of communicating their decision to withdraw. Products must be returned in their original packaging, accompanied by all accessories, documentation, tags, and the order invoice, in perfect resalable condition.

Article 12 - Warranty

All Products benefit from the legal warranty regime for normal use. The CLIENT has one (1) year from delivery to invoke the legal warranty of conformity in the event of a defect. The legal warranty of conformity entitles the CLIENT to repair or replacement within thirty (30) days of their request, free of charge. The CLIENT also benefits from the legal warranty against hidden defects for a period of one (1) year from discovery of the defect, within a maximum of five (5) years from the initial sale.

Article 13 - Data Protection

Personal information is processed in compliance with French data protection law and GDPR. Payment data is processed by SHOPIFY PAYMENTS, certified PCI-DSS. The CLIENT has the right of access and rectification of information concerning them.

Article 14 - Proof, Retention, and Archiving of Transactions

PERLEYI commits to retaining contracts of a value equal to or greater than €120 for 10 years and guaranteeing CLIENT access at all times. Contact: serviceclient@perleyi.fr

Article 15 - Intellectual Property

All elements of the website www.perleyi.fr are protected by intellectual property law and copyright, for which PERLEYI holds all rights. Any unauthorized use constitutes infringement.

Article 16 - Applicable Law and Dispute Resolution

These general terms and conditions of sale are governed by French law. In the event of a dispute, the parties commit to seeking an amicable solution before any legal action.

The CLIENT must first have attempted to resolve the dispute directly with PERLEYI by written complaint, and must submit their mediation request within one year of that written complaint.
